FIRST FILE SHARING TRIAL SHOWS FLAW IN AMERICAN COMPUTER CRIME LAW


        DULUTH, Minnesota (ACRN) - As the first full trial over illegal file
sharing begins in America, it also shows the one flaw in American
computer crime law, and why America is actually more risky than you
might think, to run a server.
        As the file opens, the question will be how responsible can you be
held, if someone finds an open relay on your computer, and starts
using it. You see, unlike in Canada, England, and several other
countries, using someone's misconfigured proxy server or open wireless
access point is NOT illegal under federal computer crime laws.
        Unlike in Canada, and England, U.S. federal law, and the laws of 45
states (there are 49 states in the Union), you CANNOT prosecute
someone if they find an open proxy/relay on your machine and post it
to the THOUSANDS of lists of such proxies. Unless there is something
like a password or other authentication/security system that says
"keep out", that relay is considered PUBLIC under Federal law, and the
laws of 45 states, and you CANNOT prosecute someone who finds your
relay and starts using it, and it will be YOU who gets prosecuted for
something they do, and NOT the other person. Because such open relays
are considered PUBLIC under the law (because they are not protected by
any password of authentication system), anyone who posts or uses any
such relays they find on your machine CANNOT BE PROSECUTED. Had this
been in Canada or England, anyone who did hijack the computer of
Jammie Thomas could be traced and prosecuted, because of the stricter
laws, but the computer crime laws of the U.S. Federal computer crime
act, and the laws of every state (except Florida, Illinois, Indiana,
and Michigan) do not allow such prosecutions, unless someone broke a
password to get in.


BUSH VETOES CHILD HEALTH CARE BILL

        WASHINGTON, DC (ACRN) - In the Christian Rights continuing war on the
left, President Bush vetoed a bill, which would have extended health
care to more children in America..
        The bill, vetoed by Bush, fell 15 votes short of the margin needed to
override in the House (though an override did get passed in the
Senate). In the opinion of THIS E-zine and THIS radio station, it is
part of the extreme Christian Right's war on the poor, and on the
left, as well. They are against socialised everything. Heck, they
would even do away with Social Security, if they could get enough of
their kronies in Congress.
        As our radio station, and E-zine has been saying for over 12 YEARS,
the hard-line right, especially the Christian Right, is WRONG for
America and WRONG for the world.
