Ok here goes:
I admit that I have used source code written by other authors without
giving them credit. However doing so is NOT illegal. It may be frowned
upon by some; but it is not and never has been illegal. In a way I provided
a service to some users that don't have the ability to take source code and
compile it into a useful program; because of their not owning A compiler
such as Visual Studio. Mostly I only ever used a few routines from several
programs to create a different program. In the one instant I used the
entire source code and put my name on it, the code I used was posted at
planet-source-code.com by someone other then the original author. Seeing as
how I had no way of finding the *original* author, I put my name on it. So
What!? There is not a programmer out there that has not at one time or
another taken source code and passed it off as his own. In my defense I
have never used any source code that was *NOT* posted for just such a
reason. In other words the source code I used, was posted at the previously
stated web site and was and still is intended for programmers to download
and use *freely* and without needing to give credit if one chooses not to.
The only other code I ever used was from Finijen or some such site, and
that site likewise stated that *anyone* could download and use that code for
free. I did ( and anyone still possessing the original code I posted )leave
in the source code kudos to the original authors. I did not however give
any credit openly, which I guess in retrospect I should have, even though I
was *not* required to do.
No on to the charge about plagiarism. I have no reason to lie about
anything at this point, so I will just say here and now for the record and
the absolute last time. My only error was to leave off quotes, I did *NOT*
do so knowingly. It is up to whom ever reads this and or the article in
question to decide whether or not I left of the quotes intentionally. As I
have said before, the original author after my contacting him and telling of
my omission and mistake, informed me that as far as he was concerned there
had not been anything done that mattered to him. He further stated (and I
still have the emails to back it up) that as far as he was concerned I need
not have my paper print any retraction. I however decided so as to remove
any possible doubt as to my honestly making an error, asked my editor to
print a retraction. My editor and their lawyers told me that there was not
any need to; because not quoting and giving credit for a line from a UseNet
public forum was at best murky where the copyright laws are concerned. My
editor wanted me to continue writing for our small home town paper; but I
said that I would finish out the quarter and then would resign; because I
wasn't getting paid any way and the column was becoming a chore instead of
another hobby.
While I am cleaning things up, here is the truth about what happened
with the bet with Nick. In a way we were both right about my sons web
pages; because even though the html of the actual web page was hosted on my
ISP's servers, my son had forgotten or I had forgotten to tell him that his
graphics likewise needed to reside on the same server as his html. He
instead put links into his own pc. After I made the bet with Nick, I
checked the ISP and FTP logs and saw where that although in the truest since
of the word I had won; because of the web page (the html) being hosted at
the ISP's site, that the graphics and such were not there and were being
brought into the page from my son's pc. I check his page from his pc and
the graphics showed up fine and then I did a view-source on his page and see
that although his html was there the graphics were not. I tried to explain
this at the time; but for what ever reason no one believed it even when I
posted the ISP logs. So I considered the bet as what the do in Vegas when
the dealer and the player have the same hand in black jack, it is a "Push"
and no one wins.
I first came to this Newsgroup (ACV) and later its off shoot ACVA-V
because of Nick having one of his (I guess)friends here in the USA call my
home using the regular telephone and threaten me with the FBI, CIA and what
ever coming to my home; because of my having posted *crippled* source code
to the Melissa virus. The person first talked to my young (at the time)
daughter and later to me. I of course told them on the phone that they were
full of shit and that no one was going to do anything about my posting
*crippled* source code to a news group, and that I could have had I wanted
to, posted the actual executable source code and there still would not have
been anything anyone could do; because I didn't write it and had nothing to
do with the writing of it, so they could piss off. I did however tell them
that I would track down what ever news group they called home and come there
and make their life miserable for there having called my home in real life.
That was several years ago as you can tell by the instigation of it being
that the Melissa code being only a very few days old, and I guess it was
because I had even found the source code so soon and posted it that made
them mad, even if it was crippled; because at the time Nick said it would be
an easy matter for anyone to remove the crippled portion and make it
useable. I told him to bugger off.
I have only ever tried to help people with their computers, it is true
that in the beginning I would help them no matter what it was they were
trying to do; but then after the internet started getting very popular, I
saw that if I continued helping the young coders and such without trying to
lead them away from maliciousness' that the very internet I enjoyed would be
at risk.
While I am at it, no matter what everyone or anyone here thinks I am
fairly competent with computers. I can repair them; but of course a chimp
could be trained to repair a pc; because it is mostly just putting cards in
and out and installing an OS. While most of the pc shops here in my small
town figure the best way to get rid of a virus or malware is to reformat and
reinstall, I am about the only one that will instead try to first irradiate
the problem and try and recover the persons data before such a drastic step.
I am directly responsible for the training of the owner of the newest
computer repair and digital photo editing store in town; because he went to
the community college branch for a pre A+ certification course, which most
should know is nothing more then learning a user what all the parts of a PC
is called and as part of the course they build their own pc. He recently
told me that had I not taken him under my wing so to speak and taught him
how to diagnose problems that he would never have been able to open his
store up. Some of you will probably say that I should have opened my own
store; but physically that is not a possibility. I started with flow charts
and such in high school, then while in the military worked on main frames,
and was a miniscule tiny part of helping with ARPA net, back when it wasn't
even called that yet; but was just the military hooked up to a few
Universities so as to prevent loss of data should any one of them be taken
out or what ever. Back while the civilian sector was still using keypunch
we in the military in 1972 had data input terminals and green screens hooked
up to main frames for data input. Although it was classified at the time
the programmers could even program the main frame using the data input
terminals; but anyone outside of our little department thought that keypunch
was still used for the programming; but it was not. I have continued
learning about computers and such since high school flow charts back in the
late sixties.
I think I should however be much better with computers then what I am,
I am none the less very competent. I am disabled and although I would give
anything to be able to hold down a job it just isn't physically possible. I
have sort of like the bone spurs one gets in your heal; but they are in my
neck and the bone spurs pinch the spinal chord bundle. That along with DDD
(Degenerative Disc Disease) DJD (Degenerative Joint Disease) Spondelosis (or
however it is spelled), I had Graves disease back in 1991 and had a goiter
the size of a soft ball under my chin and the VA tried giving me beta
blockers for 4 months but it didn't help, and operating on the thyroid gland
to remove it was not an option; because they were afraid I would have a
thyroid storm and my heart they said could literally explode in my chest;
because as it was it was running at 200 bpm resting, so they opted for what
they called an "atomic Cocktail" which in actuality was 14 millcuries of
radio active sodium iodine to burn out my thyroid gland, which every since
about a month after taking it, I have had to take synthroid or artificial
thyroid hormones.
I think, although the VA has been fighting me over it, that all the
problems with my neck and back started when I rolled a jeep in Pleiku
Vietnam back in 1973, I was knocked out for 3 days and hospitalized for 2
weeks. I was offered to be send home on what is called a blue pajama
flight, or medical flight home; but I still had 3 months to go on my tour
and I knew that if I went home early that would mean that some other guy
would have to come to Vietnam early to take my place. So I opted to just
have them tape my back up and along with a neck brace I returned to work.
Like some here have said, for a while I was a clerk typist, well that was
until the military found out about my electronic experience, and that I had
taken tests when I first became permanent party in the Army had had become a
Certified Television Equipment Repairman, which means that I didn't work on
TV's but rather worked on the equipment used to work on TV's. My primary
MOS (Military Occupational Specialty) was then changed from clerk typist to
a 26T electronics specialist and sent up to Pleiku where all the electronic
counter measures were camped at. If I had just remained a clerk typist and
stayed down in Saigon in MACV-DO (Military Airlift Command Vietnam-Director
of Operations) I would never have wrecked the jeep. It is true I had and I
guess still have according to my debriefing when I left Vietnam, a very high
security clearance, having the clearance and also having my MOS changed was
what precipitated my being sent up country to Camp Holloway at Pleiku;
because as I said that is where all the electronic country measures along
with also the PsyOps ECM (Psychological Operations, Electronic Counter
Measures). I am probably the first Vietnam Vet that some of you have ever
heard say that he was *not* a combat veteran. It is sort of funny to me
that other then my self I have yet to find another Vietnam vet that was
*not* in any combat situations. I don't know why I guess some guys just
think people will think less of them if they find out they were not shooting
a gun or something; but I am not that way, I did what I did; because I

still in effect. I was raised that you country is your country right or
wrong, and if you country goes to war, you go and do your part no matter
what the protesters think. You go and do you part and then afterwards the
wrongness or rightness of it can be debated; but I was raised that when you
live in a country and partake of all the good things it has to offer and
then you country goes and for what ever reason fights in another country you
go, whether you have any questions as to whether or not it is right you go
any way; because it is you DUTY.
I am a very happily married man that has been faithful to and have
lived with the same woman since 1979, we lived together for 2 years while I
was divorcing my first wife, then we got married and were married for 2
years before our first child was born and then another 2 years until our
second child was born and then another 3 years until our last child was
born. Two of our children have graduated High School both with honors and
above a 3.5 point average. My family and I are well respected and my
ancestors have lived in my small community since before there was a town
here. My children make the 8th generation of my family here. My wife and I
are both members of our church's choir, and volunteer for several committees
our church participates in. I because of my physical limitations can not
volunteer as much as I like. I do however fix most all of the churches here
in town's computers and don't charge them for my services. If I have the
parts on hand I don't even charge them for the parts. On of my friends said
that I am NOT the fastest computer repair person in town; but that he didn't
know of anyone that came close to being as good. Of course I had another
friend (I guess<s>) that said that because of my physically disabilities I
was one of the greatest wastes of intellect they had ever seen. Oh and
while I am letting all the chips fall where they may, I apologize for lying
about being a member of MENSA. I am not a member; but I did take the
entrance exam and I did pass it and I *could* have joined; but I did not see
the point of joining. I only took the test; because several friends had
taken the online test back when it was first put on line, and they all
wanted me to take it; because they said that I would pass it. I took the
test, passed it; but then and now if anyone in RL ever asks me, I always
find a way to skirt the issue and don't tell them I passed it; because in
RL, it doesn't matter what brain power a person has, it only matters what
they do with it.
I have had lots of fun here having a duel of wits with the *OTHER
TROLLS*, yes I admit, that I have done more trolling then what I have
helping those here. I could have and should have helped more people, and I
truly think I would have been a good resource for those needing help, had I
not got off on the wrong foot with some here. Had I not come here in the
first place just to make life in this news group hell for Nick, and had I
just came across this news group like I did the others where I actually help
people, I think things would have been vastly different. I have decided to
leave; because, well for personal reasons. For one thing as I get older I
find it more and more difficult to let some things roll off my back, where
my family is concerned. I enjoy a flame battle; but when some don't play by
the rules and start haranguing my family, when my family have nothing to do
with what goes on here, well I have to remove my self from the game.
Expressly at this time; because some things have presented their self and I
have means that I had not had up to this point. I like to think of myself
as an easy going person, and that I can keep real life and what goes on in
these news groups separate; but seeing as how recently I about did something
I would have regretted later, I decided I should leave and not come back.
Now before someone jumps to the wrong conclusion, I have not nor would I
ever consider doing anything illegal. But with that being said, I had made
some phone calls and such and found out some things from old reliable
resources that owned me favors. Nothing was ever said about news groups
except in generalities and no person or persons in particular were ever
discussed. I was only finding out what my options were should I chose to
exercise them. I was informed what it would cost for legal fees and how
long it would probably take and what if any statute of limitations were in
effect. I found out that I am sure glad I have never written a virus though
I will tell you that; because according to my sources a virus writer is
libel for any data loss and such for 7 years after or from the *last* time
any virus they either wrote or collaborated in writing is used. I had
thought the limitation was from when the virus was written; but I was
informed that should a virus get out into the wild whether the virus writer
released it or whether they only sent it to someone for that person to just
see it or what ever the virus is libel for any monetary damage. I was also
told that in the not to distant future that along with the homeland security
act, there may just be an international sort of virus security act and that
any punitive portions of the act will be retroactive back to any and all
virus that may or may not have been written. I even asked about the little
program I wrote back in commodore days that resided in the 1541 disk drive;
but was told that the powers that be are more interested in virus/worms that
interfere with internet commerce. Personally I am satisfied with just
knowing I could do what I was told I could, and to me that is enough. That
is not to say however that should something from a news group interfere or
other wise mess with my real life that those benevolent feelings may change.
I know this is long and I know that I played the "I am leaving" game
before; but I am not playing any games this time. I now have far better
things to do with my time, and this flame and war of wits has become quite
boring. Last time I left I did so with a qualification that I would return
should some continue to speak about me in the news group. However this
time, it is for good and final, and all of you can waste your time all you
like haranguing Sugien all you like; because only you here will see it;
because I won't even be lurking. Last time I didn't lurk either unless
someone put Sugien into the news group and then my bots let me know and then
I came and lurked. I got bored and then came back to play the game for a
time; but as I have said this IS THE FINAL GOOD BY.
To anyone I may have offended, I apologize. To any programmers who's code I
used, even though it was legal for me to do so, if you feel I should have
given you credit, then I likewise apologize to you. To the users of the
News groups I apologize for wasting band width and making it difficult to
sort through all the OT posts to find the help that the posters that came to
the news group were looking for.
One final thing, I can be magnanimous and can even say to those that played
the war of wits with me and played the game. Ok, you WON!, game over I
quit, and I am now returning to my wonderful real life family and friends.
It has at the very least been fun, and at worst fun; but I enjoyed it, and
however begrudgingly you like wise will have to admit you had fun. Its been
a pleasure flaming all of you; but as I said I LOST, you WON!, so sit there
an wonder whom will you now have to poke fun at?. I won't be lurking.
p.s.
I had toyed with the idea of doing one final Social Engineering of all
of you, by posting in another news group and hinting that I may have hit the
lottery and that I would now have the funds to take legal remedies at some
of you, and then just disappearing without a good by here; but I have
reconsidered and figure it would not have fooled anyone any way, so what the
heck, it will be my parting gift to you that have won, to know that my final
act was a failed Social Engineering flop.

Its theft of intellectual property and it is indeed illegal.
However, its really only illegal if the 'victim' considers it a theft. No
complaint, no crime.
Lets say you write something useful, maybe even highly desired by the
general ("willing to pay you for it") public and someone rips your code and
goes and makes money off of your idea. Illegal? Companies get beat down in
court all day long every day on cases very similar to this.
Beyond all that, I would respectfully request that you write your own code
or, if you have to use other peoples code, that you ask permission. Not
only is it respectful to do so, but its not your property in the first
place.
